BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2022 MetroDesk Media, LLC) — Hours after BocaNewsNow.com published an exclusive interview with Excell Auto Group CEO Scott Zankl, a lawsuit was filed against his company, Zankl, and his wife Kristen. The suit — obtained by BocaNewsNow.com — is not yet public, although we are publishing it in its entirety below. It was being processed Friday afternoon by the Palm Beach County Clerk of Court.

As BocaNewsNow.com reported early Friday morning, Zankl said that his dealership, normally full of high-end and exotic cars at 1001 Clint Moore Road, was empty due to actions taken by his landlord. Zankl made the comment while refuting a quickly spreading rumor that he was arrested in a federal raid of his dealership and home.

“There was no raid, no federal agents,” said Zankl. “This is not a criminal thing. It’s a dispute between me and my landlord. He illegally took possession of inventory in the middle of the night.”

But an attorney for Excell Auto Group’s Landlord in Boca Raton says that’s not true. The landlord, identified as “Auto Wholesale of Boca LLC, Ultimate Services LLC, and Moshe Farache,” claim in the lawsuit that Excell Auto is engaged in a multimillion-dollar fraud where Excell sold cars “out of trust.” That means the dealership borrowed money to buy a car, then sold the car, but didn’t return the proceeds of the car back to the lender.

We are publishing the entire lawsuit, below, which includes this accusation as an example:

“In addition to selling financed vehicles without paying (the lenders), Scott Zankl and Kristen Zankl committed fraud. By way of example (a customer) leased a 2019 Lamborghini Aventador SVJ 63 Coupe from Luxury Lease Company … Excell Auto Group, through its owners Kristen Zankl and Scott Zankl, committed fraud by attempting to use the value of the 2019 Lamborghini Aventador, that was owned by Luxury Lease Company, to reduce the debt owed to AWB, MMS and Farache.”

But Scott Zankl says the allegations are made-up.

“The claims are false,” said Zankl who had not yet been served with the suit when contacted by BocaNewsNow.com. “I have bank statements. I am going to end up on top of this.”

Zankl said his attorneys are preparing to sue the entities that are suing him, and points out that anyone can sue anyone over anything.

“Civil suits are a part of business,” he said.
